TAFE SA | PSA Requests an Urgent Hearing in The South Australian Employment Tribunal | “Student Experience Transformation” Restructure

Further to the Public Service Association (PSA) Information Update issued to all TAFE SA members on 18 October 2019, the PSA has received a response from TAFE SA to the PSA’s email outlining the concerns of the PSA and members.

TAFE SA’s response indicated that:

  •  Workload assessments would not be provided as they were “...performed as part of consultation stage 1”. The only workload assessments that have been provided to the PSA and members were in relation to TVSP exits under the current structure;
  •  TAFE SA was “...open to engaging in further discussions about the establishment of LWCF...” (Local Workload Consultative Forum). The PSA was seeking confirmation that LWCFs would be established, not just that discussions will be held; and
  •  “...TAFE SA is now in the implementation stage of the transformation and that there will be no further period of consultation.” This is despite the PSA and members not receiving workload assessments as required under Clause 15 of the South Australian Modern Public Sector Enterprise Agreement: Salaried 2017 (SAMPSEAS).

The PSA has replied to TAFE SA, advising that due to the above the matter is now in dispute in accordance with Clause 35 the SAMPSEAS. The PSA stated that TAFE SA is not allowing PSA members to engage in genuine and good faith consultation regarding Workload Assessments of the new structure as is required under Clauses 15 and 34 of the SAMPSEAS.

The PSA also stated that with the notification of this dispute to the SAET, status quo must apply, that is, further planning and progression towards implementation of the proposed new structure cannot proceed until this dispute is resolved.

The PSA will provide a further update following the SAET hearing.
