REMINDER NOTICE TO ALL MEMBERS WITH ACCEPTED RETURN TO WORK (WORKCOVER) CLAIMS

29 May 2018

APPLICATIONS FOR FUTURE SURGERY ARE DUE BEFORE YOUR ENTITLEMENT TO MEDICAL EXPENSES CEASES

Members who may need surgery beyond the date when entitlement to compensation for medical expenses ceases must notify their Department's Injury Management branch before the cut-off date.

The cut-off date will depend upon your specific case. Your entitlement to compensation for medical expenses will come to an end after a continuous period of 12 months from when you were last in receipt of weekly compensation payments.

Members should notify their claims manager in writing stating the potential need for surgery. The notification should state that they are applying pursuant to Section 33(21)(b) of the Return to Work Act and Regulation 23 of the Return to Work Regulations 2015 for a determination that it is reasonable and appropriate for such surgery to be undertaken at a later time. An example application template can be found here.

Remember - the application must be made before your entitlement to medical expenses ceases.
