Judge Dismisses Government Application to Adjourn Adelaide Remand Centre Court Case

In another positive development for members, the Deputy President of the South Australian Employment Tribunal today dismissed the Government’s application to delay the beginning of the trial in relation to consultation about the implementation of the state government’s decision to privatise the Adelaide Remand Centre.

The trial will proceed tomorrow (Wednesday 10 April 2019) despite an attempt today by the Government to have the hearing adjourned. The Government’s application follows their lodging an appeal late last week against the decision (here in particular par. 73 and 74) issued on Friday 5 April 2019. After extensive legal argument today the decision was handed down to proceed to trial.

The trial will now commence as planned and evidence will be heard about what consultation has and has not taken place, the level of compliance with the Enterprise Agreement about that consultation. The trial is set to be heard over three days.
