Dispute | Country Arts SA | Contracts of Employment

The Public Service Association (PSA) recently held a meeting with members to discuss legal advice the PSA has received about the Country Arts South Australia (CASA) contracts of employment.

The PSA is firmly of the view that the contracts CASA is issuing as “fixed term contracts” do not meet the definition of a “fixed term contract”. We say the contracts are merely contracts of administrative convenience, and employees on these recurring contracts are ongoing employees.

If staff are indeed permanent ongoing employees, these employees would be able to access the Redeployment, Retraining and Redundancy provisions of Appendix 1 of the South Australian Modern Public Sector Enterprise Agreement: Salaried 2017.

PSA Senior Industrial Officer was present at the meeting to explain the dispute process and answer questions that staff had.

At the meeting two motions were proposed and unanimously endorsed by all members present.

  •  PSA Members at the CASA meeting of 31 October 2019 endorse the lodging of a dispute in relation to the CASA standard fixed term contracts.
  •  PSA members endorse the escalation of the dispute to the SAET if required.

The PSA has now written to CASA to formally advise of a dispute in relation to the standard fixed term contracts issued to its employees.
