Announced Changes to Injury and Claims Management

The PSA was advised on 7 November about Cabinet's in principle decision of 31 October 2016 to transfer administration of new Return to Work claims to ReturnToWorkSA Claims Agents from 1 July 2017.

We are advised that Cabinet has requested a transition plan be developed and approved by the Cabinet before the end of this year. The transition plan is to be developed by the Under Treasurer, Commissioner for Public Sector Employment and the CEO of ReturnToWorkSA.

The Office of the Commissioner for Public Sector Employment has stated that they are not expecting job losses apart from possibly in the claims administration function; however the PSA has serious doubts about the reality of this advice.

The PSA was also advised by the Office of the Commissioner for Public Sector Employment that Rehabilitation and Return to Work services would be retained. Correspondence from the Office of the Commissioner for Public Sector Employment stating that the obligation on all Agencies 'to continue to support and facilitate the Return to Work of injured workers' does not confirm that Rehabilitation & Return to Work services will remain in the public service and not be outsourced.

The PSA has concerns around what public sector Return to Work services will be in place beyond 30 June 2019.

While the PSA was advised by the Office for Commissioner for Public Sector Employment that proper consultation with the PSA will commence shortly, we were not advised before the release of the email from the Commissioner for Public Sector Employment on Friday 4 November 2014. This email clearly caused significant concern about what constitutes genuine consultation. These concerns on the basis that it infers a pre-determined decision will be raised directly with the Offices of Commissioner for Public Sector Employment and the Minister to ensure that not only genuine consultation takes place, but that extensive consultation will take place prior to any proposed changes.
